These Master Contest and Giveaway Rules (the “Master Rules”) govern every contest, giveaway, prize draw, and sweepstakes (each, a “Contest”) conducted by Budtenders Association Inc. (“BTA”, the “Sponsor”) on or through its platform, unless a Contest expressly states otherwise. Each Contest is also governed by its Contest Summary (see Section 2), which states the Contest-specific details. If a Contest Summary conflicts with these Master Rules, the Contest Summary prevails for that Contest.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
1.1 The Sponsor of each Contest is Budtenders Association Inc., 4933 King St, Beamsville ON L0R1B0, [email protected], unless the Contest Summary identifies a co-sponsor. Prizes may be supplied by third-party prize partners identified in the Contest Summary; prize partners are not administrators of the Contest.
2.1 Each Contest is announced with a Contest Summary stating: (a) the Contest name; (b) the opening and closing date and time (Eastern Time); (c) the prize(s), their approximate retail value, and any prize partner; (d) the number of winners and selection date; (e) the entry methods available, including how platform points may be used to obtain entries, if applicable; and (f) any eligibility terms additional to these Master Rules. The Contest Summary must be published with, and hyperlinked to, these Master Rules.
3.1 Contests are open to individuals who, at the time of entry: (a) are legal residents of Canada, excluding the Province of Quebec [unless the Contest Summary expressly includes Quebec and French-language rules are provided]; (b) have reached the legal age for cannabis purchase in their province or territory of residence; and (c) hold an active BTA member account in good standing.
3.2 The following are not eligible: employees, contractors, directors, and officers of BTA and of any prize partner identified in the Contest Summary, and members of their immediate households. BTA may verify eligibility and may require proof of age, residency, and identity before awarding any prize.
4.1 Platform Entries. The Contest Summary states the entry methods for each Contest, which may include entries obtained by redeeming platform points or completing platform activities.
4.2 Free Entry Method. For every Contest, an entrant may obtain one (1) entry without purchase, payment, points redemption, or completion of any platform activity, by submitting the no-purchase entry form at [URL] (or the method stated in the Contest Summary) with their name, email address associated with their member account, and the Contest name, during the Contest period. Limit one no-purchase entry per person per Contest unless the Contest Summary states otherwise. No-purchase entries have equal chances of winning as all other entries.
4.3 Entry Conditions. Limit of entries per person, if any, is stated in the Contest Summary. Entries generated by script, bot, or automated means, entries from duplicate accounts, and entries that are incomplete or received after the closing time are void. Entries become the property of BTA and are subject to BTA’s Privacy Policy.
5.1 Unless the Contest Summary states a skill-based or judged format, potential winners are selected by random draw from all eligible entries received, on the date stated in the Contest Summary. The odds of winning depend on the total number of eligible entries received.
5.2 Conditions of Winning. Before being declared a winner, each selected entrant must: (a) correctly answer, unaided, a time-limited mathematical skill-testing question; and (b) sign and return BTA’s standard declaration of eligibility and liability/publicity release within five (5) business days of notification. If a selected entrant does not satisfy these conditions, cannot be contacted within five (5) business days using the contact information on their account, or declines the prize, that entrant is disqualified and BTA may select an alternate entrant.
6.1 Prizes are as stated in the Contest Summary. Prizes must be accepted as awarded, are not transferable or convertible to cash, and may not be sold. BTA may substitute any prize with a prize of equal or greater value if the stated prize becomes unavailable. No Contest prize will consist of cannabis or any product containing cannabis. Where a prize involves event attendance or travel, the winner is responsible for all costs not expressly included in the Contest Summary. Winners are responsible for any tax consequences of accepting a prize, if applicable.
6.2 Prizes will be delivered within thirty (30) days of the winner satisfying the conditions in Section 5.2, unless the Contest Summary states otherwise. Where a prize partner fulfils a prize directly, BTA will share the winner’s name and delivery details with that partner for fulfilment purposes only.
7.1 By accepting a prize, the winner consents to BTA’s publication of the winner’s first name, last initial, and province, and — only with the winner’s separate written consent in the release form — photograph or likeness, in Contest-related announcements, without further compensation.
8.1 Personal information collected in connection with a Contest is collected by BTA and used to administer the Contest (including eligibility verification, winner selection, notification, publication under Section 7, and prize fulfilment) and as described in BTA’s Privacy Policy. Contest entry information is not used for marketing purposes unless the entrant has separately consented.
9.1 BTA may cancel, suspend, or modify a Contest, with notice on the platform, if fraud, technical failure, or any cause beyond BTA’s reasonable control impairs the integrity or proper conduct of the Contest, in which case BTA may select winners from eligible entries received before the impairment. BTA may disqualify any entrant who tampers with the entry process, violates these Master Rules or the Membership Terms & Conditions, or acts in a disruptive or deceptive manner.
9.2 All decisions of BTA regarding the administration of a Contest, including winner selection and eligibility, are final and binding, subject to applicable law.
9.3 By entering, each entrant releases BTA, its directors, officers, employees, contractors, and prize partners from any claim arising from participation in the Contest or the acceptance, use, or misuse of any prize, to the maximum extent permitted by applicable law. Nothing in these Master Rules limits rights that cannot be limited under applicable consumer protection law.
9.4 These Master Rules are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. If any provision is held unenforceable, the remainder continues in force. These Master Rules and the applicable Contest Summary are the entire rules for each Contest.
10.1 BTA may update these Master Rules from time to time; the version in force at a Contest’s opening date governs that Contest. Each version is dated and archived, and prior versions are available on request.
